These Terms of Use ("Terms") govern your access to and use of StabilityTest, available at https://stabilitytest.io/, including its internet testing and diagnostic tools, network and service-status information, content, features, APIs, software, measurement systems, and related functionality (collectively, the "Service").

StabilityTest ("StabilityTest," "we," "our," or "us") provides the Service subject to these Terms. By accessing or using the Service, you agree to these Terms. If you do not agree, you should not access or use the Service.

About StabilityTest

StabilityTest is an internet and network analysis platform. Its primary connection-testing tool helps users evaluate characteristics of a network connection such as latency, jitter, failed requests or probes, connection drops, and connection consistency. It summarizes these as a Stability Score and Stability Grade alongside related performance measurements.

The Service may also provide information relating to network and third-party service conditions, including service availability, incidents, and operational status, and StabilityTest is developing a Network Updates system that monitors publicly available or third-party status sources and may publish information about service incidents and changes. StabilityTest may use distributed infrastructure and third-party providers to operate portions of the Service, including measurement endpoints, hosting, network infrastructure, and connection-information services.

The Service is provided for informational and diagnostic purposes. Its nature and limitations are described further below and in the Disclaimer.

Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that:

• you are at least 13 years old;
• you have the legal capacity to enter into these Terms; and
• your use of the Service complies with all applicable laws and regulations.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

License to Use the Service

Subject to these Terms, StabilityTest grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for lawful personal, educational, informational, or business purposes.

This license does not grant you ownership of any part of the Service, and all rights not expressly granted are reserved by StabilityTest.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• violate any applicable law or regulation;
• attempt to gain unauthorized access to any systems, networks, accounts, or data;
• interfere with, disrupt, or degrade the operation of the Service;
• circumvent, disable, or attempt to defeat any security or access-control measure;
• introduce malicious software, viruses, or automated abuse tools;
• use the Service in a way that could damage, disable, overburden, or impair the website, measurement endpoints, APIs, or the infrastructure (including third-party infrastructure) that supports the Service;
• use automated systems to generate excessive testing traffic without prior authorization;
• bypass or attempt to bypass rate limits or other abuse-prevention mechanisms;
• scrape, harvest, or systematically collect data from the Service without prior written permission, except where such restriction is prohibited by applicable law;
• reverse engineer, decompile, or attempt to extract source code from protected portions of the Service, except to the extent such restriction is prohibited by applicable law; or
• attempt to reproduce protected StabilityTest functionality through unauthorized automated access.

We may implement rate limits, block or suspend requests, or restrict or terminate access for users, devices, networks, or systems that interfere with the reliability, security, integrity, or availability of the Service.

APIs and Automated Access

StabilityTest may operate APIs, measurement endpoints, or other machine-accessible infrastructure as part of the Service. The existence of a publicly reachable endpoint does not by itself grant permission to use that endpoint for automated, bulk, commercial, abusive, or unrelated purposes.

Unless StabilityTest expressly authorizes otherwise, you may not use automated systems to generate excessive requests, reproduce StabilityTest functionality, circumvent normal interfaces, bypass technical restrictions, or place unreasonable load on StabilityTest or supporting third-party infrastructure. StabilityTest may impose rate limits, authentication requirements, access controls, request restrictions, or other technical protections at any time.

Network Testing and Measurement Infrastructure

StabilityTest performs network measurements using infrastructure that it selects and configures, which may include third-party cloud, edge-computing, content-delivery, or network infrastructure providers. Measurement requests may be transmitted through third-party infrastructure, including the Cloudflare infrastructure currently used for StabilityTest's latency measurement endpoint.

The location, routing, capacity, availability, configuration, and performance of measurement infrastructure may affect test results. StabilityTest may modify, replace, relocate, expand, or discontinue measurement infrastructure as the Service evolves. The use of a third-party provider does not imply that the provider sponsors, endorses, or guarantees StabilityTest or its results. How information is handled in connection with this infrastructure is described in the Privacy Policy.

Test Results and Diagnostic Information

Results generated by the Service are measurements and calculations based on conditions observed during a particular test. Internet and network performance can be affected by many factors, including:

• network congestion;
• device and hardware limitations;
• browser behavior;
• routing conditions;
• ISP infrastructure;
• Wi-Fi or other wireless interference;
• geographic distance;
• measurement-endpoint conditions;
• temporary outages;
• third-party network infrastructure; and
• other conditions outside StabilityTest's control.

Because these variables can change, StabilityTest does not guarantee the accuracy, completeness, reliability, repeatability, or consistency of any result. A Stability Score, Stability Grade, latency measurement, jitter calculation, failed probe, detected connection drop, or other diagnostic output reflects conditions observed or calculated during a particular test and is not a guarantee of present or future network performance.

You should not rely solely on StabilityTest results when making technical, financial, contractual, legal, or business decisions. Additional context on the limitations of diagnostic information is provided in the Disclaimer.

Network Updates and Third-Party Status Information

As part of the Service, StabilityTest may collect information from public or third-party status sources and may aggregate, summarize, classify, organize, display, publish, distribute, and update information about network and third-party service conditions, including incidents and operational changes.

Third-party service-status information may be delayed, incomplete, unavailable, inaccurate, or changed after publication, and it may depend on third-party reporting that is itself affected by source failures or network conditions. Accordingly, StabilityTest does not guarantee that:

• every outage or incident will be detected or reported;
• any status update is complete or current;
• information obtained from third-party sources is accurate;
• the absence of a reported incident means a service is operating normally; or
• reported conditions apply to every user, network, or geographic region.

Where authoritative or time-critical status information is required, you should consult the applicable provider's official channels. Monitoring, reporting on, referring to, or displaying information about a third-party company, platform, product, or service does not imply affiliation, sponsorship, endorsement, partnership, or authorization unless StabilityTest expressly states otherwise.

No Professional Advice

The Service is provided for informational and diagnostic purposes only. Nothing provided through the Service constitutes professional engineering, telecommunications, legal, financial, or technical consulting advice, or a certification or guarantee of network performance. You should consult a qualified professional where appropriate.

No High-Risk Use

The Service is not designed or intended to serve as a safety-critical system. You agree not to use it as, or as a component of, emergency-communications, life-support, medical, aviation, industrial-control, or other high-risk systems in which inaccurate information, failure, or unavailability could reasonably result in death, personal injury, or substantial physical or environmental damage.

Intellectual Property

The StabilityTest website, platform, software, source code, APIs, measurement systems, scoring systems, algorithms, designs, graphics, text, logos, brand, features, functionality, and original compilations and presentations of content are owned by StabilityTest or its licensors and are protected by applicable intellectual-property laws.

Except as expressly permitted by these Terms or applicable law, you may not copy, reproduce, distribute, modify, publish, create derivative works from, sell, license, or commercially exploit any protected part of the Service without prior written permission. Nothing in these Terms transfers ownership of any StabilityTest intellectual-property rights.

Third-Party Names and Trademarks

Third-party names, trademarks, service marks, and logos referenced in or displayed through the Service remain the property of their respective owners. Their appearance does not imply affiliation with, sponsorship by, or endorsement by those owners, and StabilityTest claims no ownership of them.

Where the Service uses publicly available or third-party information, that information remains subject to its source's own availability and accuracy. StabilityTest may transform, summarize, classify, or present such information as part of its own Service where legally permitted, but does not claim to hold rights it has not been granted in third-party data or content.

User Feedback

If you submit suggestions, ideas, recommendations, feedback, or feature requests to StabilityTest, you grant StabilityTest a perpetual, worldwide, royalty-free, irrevocable license to use, modify, incorporate, and implement that feedback without restriction or compensation. This does not transfer ownership of personal information contained in your communications, which remains subject to the Privacy Policy.

Third-Party Services and Links

The Service may use, integrate with, reference, or link to third-party websites, infrastructure, products, and services, including providers involved in hosting and infrastructure, network and edge-computing services, connection-information services, analytics, security, advertising, and affiliate or referral programs, as well as third-party status sources.

StabilityTest does not control and is not responsible for the availability, content, products, services, policies, privacy practices, security practices, or operational changes of third parties. Your interactions with third-party services are governed by those providers' own terms and policies.

Advertising and Promotional Content

StabilityTest may display advertising, sponsored placements, promotional content, or other commercial messages, which may be provided by third parties. The presence of advertising or promotional content does not constitute a guarantee, warranty, or endorsement of the advertised product or service unless StabilityTest expressly states otherwise.

StabilityTest does not guarantee the accuracy, availability, security, suitability, performance, or reliability of products or services promoted through advertising, and any transaction or relationship between you and an advertiser or third-party provider is solely between you and that party. How advertising technologies and cookies are handled is described in the Privacy Policy and Cookie Policy.

Affiliate and Referral Links

StabilityTest may include affiliate or referral links to third-party products or services, such as Proton VPN. These links may contain identifiers that allow a third-party provider to attribute a visit, subscription, purchase, or other qualifying action to StabilityTest, and StabilityTest may receive a commission or other compensation for qualifying actions. This generally does not increase the price you pay unless otherwise disclosed.

Affiliate relationships do not constitute a guarantee of any third-party product's or service's performance, availability, security, suitability, or results. Third-party products and services accessed through affiliate or referral links remain governed by their own terms, policies, and commercial conditions, and your interactions with those providers are solely between you and the applicable provider.

Service Availability and Changes

StabilityTest aims to maintain reliable access to the Service but does not guarantee uninterrupted or error-free availability. The Service, or any portion of it — including measurement endpoints, APIs, scoring systems, Network Updates, third-party integrations, and other features — may be modified, updated, reconfigured, suspended, restricted, replaced, or discontinued at any time as the Service evolves.

StabilityTest is not responsible for interruptions, downtime, outages, delays, routing changes, third-party failures, or other service disruptions, subject to the Disclaimer of Warranties and Limitation of Liability below.

Privacy and Cookies

How StabilityTest collects, uses, and handles information in connection with the Service — including network testing, connection-information lookups, third-party infrastructure, analytics, advertising, and affiliate or referral activity — is described in the Privacy Policy. The use of cookies, browser storage, and similar technologies is described in the Cookie Policy.

The Privacy Policy and Cookie Policy are informational notices provided for transparency. They describe StabilityTest's practices but are not part of these Terms and are not contractual conditions of use. Please review them to understand how your information and browser technologies are handled.

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, STABILITYTEST DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, AND SECURITY.

StabilityTest does not warrant that the Service will be error-free or uninterrupted, that results will be accurate or repeatable, that the Service will always be available, that measurement infrastructure will remain unchanged, that defects will be corrected, or that the Service will be free of harmful components. Your use of the Service is at your own risk. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STABILITYTEST AND ITS OWNERS, OPERATORS, AFFILIATES, EMPLOYEES, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, including damages related to loss of data, loss of profits, business interruption, lost revenue, lost goodwill, network issues, service interruptions, reliance on test results, or third-party services or infrastructure.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF STABILITYTEST ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100 USD).

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless StabilityTest and its affiliates, owners, operators, employees, contractors, licensors, service providers, and partners from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable legal fees, arising out of or relating to:

• your misuse of the Service;
• your violation of these Terms;
• your violation of applicable law;
• your infringement or violation of the rights of another party; or
• unauthorized or abusive automated use of the Service or its infrastructure.

Suspension and Termination

We may suspend, restrict, block, or terminate your access to the Service when reasonably necessary to protect StabilityTest, its users, supporting infrastructure, third-party providers, or others, or when we reasonably believe these Terms have been violated. We may also discontinue all or part of the Service independently of any violation.

Termination or restriction of access does not limit any rights or remedies available to StabilityTest under applicable law. Provisions that by their nature should survive termination — including intellectual-property, warranty-disclaimer, liability-limitation, indemnification, and governing-law provisions — will survive.

Governing Law and Jurisdiction

These Terms are governed by and interpreted in accordance with the laws of the State of Florida, United States, without regard to its conflict-of-law principles, except to the extent applicable law requires otherwise. To the extent legally permitted, disputes arising out of or relating to these Terms or the Service are subject to the jurisdiction of the state or federal courts located in Florida.

Nothing in this section limits any rights you may have under mandatory consumer-protection laws in your place of residence that cannot legally be waived or restricted.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms, together with any additional terms that StabilityTest expressly applies to a particular service or feature, constitute the entire agreement between you and StabilityTest regarding your use of the Service and supersede any prior understandings on that subject.

The Privacy Policy, Cookie Policy, and Disclaimer are referenced in these Terms for your information. They describe StabilityTest's practices and provide additional context, but they are informational notices rather than contractual terms.

Changes to These Terms

We may revise these Terms from time to time to reflect changes to the Service, technology, business practices, or applicable requirements. Updated versions will be posted on this page with a revised effective date, and for material changes we will take reasonable steps to indicate that the Terms have been updated.

Continued use of the Service after revised Terms take effect constitutes acceptance of the updated Terms to the extent permitted by applicable law. We will not apply materially different terms retroactively except as required or permitted by law.
